You agree that you will not share your account or allow someone else to use your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for a prolonged period.

3. License & Usage Rights

Gamesofa Inc. grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Game solely for your personal, non-commercial entertainment use, subject to these Terms.

All rights, title, and interest in and to the Service (including the Game, its features, graphics, content, virtual items, and intellectual property rights) remain with Gamesofa Inc. or its licensors.

You may not copy, modify, distribute, create derivative works of, reverse engineer, decompile, or attempt to extract the source code of the Game, except as permitted by law.

4. Virtual Items & In-App Purchases

The Service may include virtual goods, virtual currency, virtual items (“Virtual Items”) available for purchase or through game play.

Virtual Items have no real-world monetary value and cannot be redeemed for cash, real-world goods or services, or transferred outside the Game unless expressly permitted by Gamesofa Inc..

All purchases are final, except as required by applicable law. No refund is guaranteed unless required by law.

You acknowledge that Gamesofa Inc. may modify, remove, or disable Virtual Items, features or content at any time without liability to you.

5. General Rules of Conduct

When using the Service you agree to:

• Comply with all applicable laws and regulations.
• Not use the Service to cheat, defraud, manipulate gameplay, exploit errors or bugs, or engage in any unauthorized activity.
• Not use the Service to transmit or distribute any harmful, illegal or infringing content, including viruses, malicious code or infringing intellectual property.
• Not attempt to gain unauthorized access to the Service, other accounts, or the systems or networks connected to the Service.
• Not use the Service in any way that could impair the performance, security or proper functioning of the Service.

6. Termination & Suspension

Gamesofa Inc. may suspend, restrict or terminate your access to all or part of the Service at any time and for any reason, including without limitation for violation of these Terms or suspected fraudulent or unauthorized activity, without liability to you.

Upon termination:

• Your rights to access the Service and any content will immediately cease.
• Unless required by applicable law, no refund or reimbursement will be provided for unused Virtual Items, game time or purchases.
• The license granted to you under these Terms will terminate.

7. Disclaimers & Limitation of Liability

Your Use Of The Service Is At Your Own Risk. The Service Is Provided “As Is” And “As Available.” Gamesofa Inc. Disclaims All Warranties, Whether Express Or Implied, Including Warranties Of Merchantability, Fitness For A Particular Purpose, Non-Infringement, And That The Service Will Be Uninterrupted Or Error-Free.

To The Maximum Extent Permitted By Law, In No Event Will Gamesofa Inc. Or Its Affiliates Be Liable For Any Indirect, Incidental, Special, Consequential Or Exemplary Damages (Including Loss Of Profits, Revenue, Data Or Use), Arising Out Of Or In Connection With Your Use Of Or Inability To Use The Service, Even If Advised Of The Possibility Of Such Damages.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you.

8. Intellectual Property

The Service, including all content, graphics, logos, icons, video and audio clips, software and all other materials, are owned by Gamesofa Inc. or its licensors and protected by copyright, trademark, patent and other applicable laws.

You acknowledge and agree that you have no ownership or other property interest in your User Account or any Virtual Items, content or features of the Service other than the limited license to use the Service as set out in these Terms.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy to understand our data collection, use and disclosure practices.

10. Updates to the Service & Terms

We may modify or update the Service from time to time in our sole discretion, including adding or removing features, content, Virtual Items or subscription options.

We may also modify these Terms from time to time. We will provide notice of any material changes (e.g., via the Game, email or website) and update the “Last Updated” date.

Your continued use of the Service after such changes indicates your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and may request account termination.

11. Governing Law & Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of New York and the federal laws of the United States of America applicable therein, without giving effect to any conflict of law rules.

You agree that any dispute, controversy or claim arising out of or relating to these Terms or the Service will be resolved through binding arbitration by a single arbitrator under the rules of the American Arbitration Association (AAA), unless otherwise agreed. If the jurisdiction in which you reside prohibits mandatory arbitration, then you retain the right to bring claims in your local court.

You also agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in New York County, New York for any matter not subject to arbitration.

12. Age & License Restrictions

The Game is intended for users who are of legal age in their jurisdiction to use entertainment-style casino games. If you are under the required age, you must not use the Service.

The Game does not offer real-money gambling, wagers, or cash-out of Virtual Items for real money. It is a social, entertainment game only.

If you are located in a jurisdiction where such social casino games are prohibited, you must not use the Service.

13. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, that provision will be struck out without affecting the remaining provisions, which will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and any Supplemental Terms (e.g., game-specific rules, in-app purchase terms) constitute the entire agreement between you and Gamesofa Inc. regarding the Service.

If we choose to assign or transfer our rights under these Terms, the Terms will remain binding on you.
